What these terms coverО чём документ
These terms apply to the software Axiomativ builds and operates for businesses: websites, customer databases, staff panels and messaging automation across WhatsApp, Telegram and Instagram. A separate written agreement with a client prevails over these terms where the two differ.
Условия относятся к программам, которые Axiomativ создаёт и обслуживает для компаний: сайтам, клиентским базам, панелям сотрудников и автоматизации переписки. Отдельный договор с заказчиком имеет приоритет.
Who may use itКто может пользоваться
Access to staff panels and dashboards is granted to named people at the client's request. Credentials are personal and must not be shared. The client is responsible for keeping its own staff list current and telling us when someone leaves.
Доступ к панелям выдаётся конкретным людям по заявке заказчика. Учётные данные личные, передавать их нельзя. Заказчик отвечает за актуальность списка сотрудников и сообщает об увольнениях.
Messaging rulesПравила переписки
When we connect a business to WhatsApp, Instagram or Telegram, that business must follow the platform's own rules. In particular: messages may be sent only to people who agreed to be contacted, every marketing message must offer a way to stop, and message templates must describe honestly what they will say. We will refuse to send bulk messages to purchased or scraped contact lists, and we will suspend automation that generates blocks or complaints.
Подключая компанию к WhatsApp, Instagram или Telegram, мы работаем по правилам этих платформ: писать можно только тем, кто согласился, у каждой рассылки должен быть способ отписаться, шаблоны обязаны честно описывать содержание. Рассылки по купленным или собранным на стороне спискам мы не делаем, а автоматику, которая собирает жалобы и блокировки, останавливаем.
What we promise, and what we do notЗа что отвечаем
We keep the software running and fix faults as fast as we reasonably can. We do not promise uninterrupted service: parts of it depend on Meta, Telegram, hosting providers and the client's own accounts, and an outage or policy change on their side can stop delivery. We are not liable for indirect losses such as lost profit; where liability cannot be excluded, it is limited to the fees paid for the affected month.

Бесперебойной работы не обещаем: часть зависит от Meta, Telegram, хостинга и собственных аккаунтов заказчика. За упущенную выгоду не отвечаем; в остальном ответственность ограничена платой за затронутый месяц.
Data and contentДанные и материалы
Customer data belongs to the client. Photos, texts and price lists the client provides remain theirs; by giving them to us they allow us to publish and use them within the systems we build for them. Code and reusable components we write remain ours, and the client receives the right to use them for as long as the service continues. On termination we export the client's data to them in a usable form.
Клиентские данные принадлежат заказчику. Фотографии, тексты и прайсы остаются его, а передавая их, он разрешает использовать материалы в создаваемых для него системах. Код и переносимые части остаются нашими, заказчик получает право пользоваться ими на время обслуживания. При расторжении отдаём данные в пригодном для работы виде.
Payment and terminationОплата и прекращение
Fees, scope and notice periods are set in the agreement with each client. Either side may end the arrangement with 30 days' notice. Platform fees charged by Meta for messages are passed through at cost and are payable by the client directly to the platform.
Стоимость, объём и сроки уведомления определяются договором. Любая сторона может прекратить сотрудничество, предупредив за 30 дней. Плата Meta за сообщения идёт без наценки и оплачивается заказчиком напрямую платформе.
